Summer, I know nothing about I.R.S so can't comment on it. However, I sometimes read postings here which precisely sum up what is going on with the N The next question is; 'What shall I do, what shall I say?' Your posting exactly details the situation so why not submit it exactly as it is. You don't need to say it was posted here, you could say you wrote to a friend asking there advice and it's the best way you can explain your situation. You could edit it slightly if you know N will eventually see it. I can tell you it will speak volumes with the IRS. Something which 'comes from the heart' as this does can carry more weight than a carefully prepared defence.
By the way, did you see my 'Spooky Story' in 'Anything Goes' in the psychopath forum? It's just a diversion from your ever present problems. _________________ Sailor

Summer, I know you will say only the truth to the IRS and this will come shining through to them. I understand that you want to give them a full picture of N but be careful you do not appear vindictive. Everyone here knows you are not like that in any way, but for fear of appearing so, I don't think I would mention the custody aspect unless it is directly relevant to the IRS matters.

In a situation like this, it is well worth it to hire an accountant who is experienced in tax litigation. They will charge by the hour for consultation. Take these questions to them. They will be able to tell you exactly what the IRS is looking for, what to tell them, what not to tell them. Don't guess, ask an experienced professional. It's what they do.
I have a accountant that I have been using as a tax consultant for years, even though I did my own taxes. He promised me from the start that I would reap the rewards in tax savings many times his fee, and so far he's been right. I even had a field audit once, and he was by my side for all 5 hours of it, and defended any criticism the auditor made of my books, saying we'd be happy to discuss it in tax court. At the end, the auditor shook my hand, told me I had been doing a good job, and filed "no changes". That would never have happened without my tax consultant.
It's a worthwhile investment. Ask around, get a referral. They're actually a lot cheaper than lawyers, too.

Summer, from what you say, it sounds like the overall abuse IS relevant to I.R.S matters. If so, give them all the FACTS you can. N won't like it but what the hell! You have to defend YOUR position with the I.R.S so I would not pull any punches. Remember that the tax man was Al Capone's final downfall. Maybe N will finally get his comeuppance even though your objective here is to defend yourself with I.R.S. Do you have to formally state to them that you are claiming 'innocent spouse'? It's not something I've heard of in U.K. By the way, I've just spent my weekend doing my own tax returns, I absolutely hate doing them. I haven't got a financial sort of mind: I earn the money and I spend it, what's tax got to do with that? (joke) _________________ Sailor

Summer,
It will feel great to have it all off in the mail today, I'm sure. As you said, you're giving it your best shot and that's all you can do. You're doing great, moving forward, cutting those ties.
If the IRS denies your innocent spouse relief, THAT would be a good time to find a tax accountant. It sounds like it would be less expensive than paying half. At least you should be let off from paying half the interest and fines. But let's hope they see it for what it really is.
